1. Introduction

By accessing or using the website b2bdatahive.com and purchasing products from it, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, do not use our services or purchase our products.

2. Definitions

  • “We / Us / Our” means  Data Hive, operator of b2bdatahive.com.

  • “You / Customer / Buyer” means the individual or legal entity purchasing products from this website.

  • “Products” means digital data files, databases, lists, or other downloadable content sold via the website.

  • “Download Link” means a secure link generated for downloading purchased Products.

3. Nature of Products

All Products sold on this website are digital downloadable files (B2B intelligence datasets) delivered electronically. By purchasing, you acknowledge that no physical goods will be shipped.

4. Ordering and Payment

  • Orders are placed directly through our checkout system. All purchases must be paid in full prior to delivery of the digital Product.

 

  • Payments are securely processed through our authorized payment processors. Available payment methods appear at checkout and may change from time to time. We do not control payment provider policies; any disputes related to payment processing should first be raised with the payment provider and then with us if unresolved.

 

  • You are responsible for providing accurate billing information. We reserve the right to refuse or cancel any order that appears suspicious or fraudulent.

5. Delivery, Download Links and Limits

  • Upon successful payment, a secure Download Link for each purchased Product will be created.

  • Download link validity: Download Links expire 72 hours after purchase (or such longer/shorter period displayed at checkout).

  • Download attempts: Each purchase entitles the Buyer to up to 3 (three) downloads of the purchased file(s), after which the link will become invalid.

  • Download Links are for the exclusive use of the purchasing party and are non-transferable. Sharing of Download Links, files, or content with third parties is strictly prohibited.

  • If you experience technical difficulties with a download, contact support at info@b2bdatahive.com within 14 days of purchase so we may assist or, where applicable, provide a replacement file.

6. License and Use Restrictions

  • We grant you a non-exclusive, non-transferable, limited license to use the purchased Product for your internal business purposes (marketing campaigns, lead generation etc.) only.

  • Prohibited uses: resale, sublicense, distribution, publication, broadcasting, sharing, or any re-packaging of the Product for third-party use is strictly forbidden unless an express written license is granted by us.

  • You may not use the Products for unlawful purposes, including but not limited to sending unsolicited bulk communications in violation of applicable laws (spam laws).

7. Accuracy, Verification & Compliance

  • We take commercially reasonable steps to verify contact data (including DNS checks and recognized email validation standards) and to maintain GDPR-awareness in our datasets. However, we do not guarantee 100% accuracy or completeness of the data.

  • It is the Buyer’s responsibility to perform any additional verification required for their own compliance needs. Buyers are solely responsible for ensuring their use of the data complies with all applicable laws and regulations (including data protection and marketing laws) in their jurisdiction and the recipients’ jurisdictions.

8. Intellectual Property

  • All intellectual property rights in the Products, website content, branding, and related materials remain the exclusive property of Data Hive or our licensors.

  • Your purchase grants no ownership rights to the underlying datasets or the compilation rights — only the limited license described above.

9. Pricing and Taxes

  • All prices are shown on the website. Unless otherwise stated, prices do not include applicable taxes, duties or VAT, which will be added at checkout where required by law.

  • Buyers are responsible for any local taxes, fees, or duties imposed by their country of residence.

10. Refunds and Cancellations

  • Digital products: Due to the nature of digital delivery, we do not offer refunds once a Product has been downloaded by the Buyer, except where required by applicable consumer protection laws or in cases where the Product is demonstrably defective.

  • Defective files / technical faults: If a purchased file is corrupted or not as described, contact us at info@b2bdatahive.com within 14 days of purchase. Where we verify the defect, we will either (a) provide a corrected file, or (b) issue a refund at our discretion.

  • To request a refund or replacement you must include order details and a description of the problem.

11. Security and Account Responsibility

  • You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

  • We implement reasonable technical and organizational measures to protect Products and customer data, but we cannot guarantee absolute security. See our Privacy Policy for more details.

12. Warranties and Disclaimers

  • No warranty: Except as expressly provided, Products are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

  • We do not warrant that the Products will meet your requirements, be error-free, or uninterrupted.

13. Limitation of Liability

  • To the fullest extent permitted by applicable law, Data Hive shall not be liable for:

    • indirect, incidental, special, consequential or punitive damages;

    • lost profits, business interruption, loss of data or loss of revenue;

    • any damages arising from your use of the Products or inability to use them.

  • Our total aggregate liability for any claim related to the Products or these Terms shall not exceed the total amount paid by you for the specific Product giving rise to the claim.

14. Indemnification

You agree to indemnify, defend and hold harmless Data Hive, its officers, employees and partners from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

  • your use or misuse of the Products;

  • your violation of these Terms;

  • your violation of any applicable law, including data protection and anti-spam laws;

  • any claim that content you provided or actions you took infringes third-party rights.

15. Suspension and Termination

  • We reserve the right to suspend or terminate any account or access to Products if we suspect fraudulent activity, violation of these Terms, or misuse of Download Links.

  • Termination does not affect rights or liabilities that accrued prior to termination.

16. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of Montenegro.

  • Any dispute arising out of or relating to these Terms shall be submitted to the competent courts of Montenegro. Where applicable consumer protection laws grant you other rights, those laws will apply.

17. Changes to These Terms

We may modify these Terms at any time. We will post updated Terms on the website with a revised “Last updated” date. Continued use of the website or purchase of Products after changes constitutes your acceptance of the revised Terms.

18. Miscellaneous

  • Severability: If any provision of these Terms is held invalid, the remainder will remain in full force and effect.

  • Entire Agreement: These Terms, together with our Privacy Policy and any order confirmation, constitute the entire agreement between you and Data Hive relating to the subject matter hereof.
